Numerous states have adopted rules requiring associations to follow parliamentary procedure in association meetings. Courts generally hold organizations accountable to the principles and rules of parliamentary law, even without specific state statutes. If an organization ignores or incorrectly applies parliamentary procedure to the detriment of the organization or its members, then the association and/or its officers open itself to liability that could even result in lawsuits. While Robert’s Rules of Order Newly Revised (RONR) is the most widely used parliamentary authority, it is not the only option that can be identified in your organization’s bylaws as being the authority you follow, unless specifically identified to be utilized by state statute. Should RONR be identified, the “current edition” should be specified so the bylaws do not have to be amended when new editions are released, which is about every ten years.

Parliamentary procedure in Community Associations has to be customized to the organization depending on the state statues guidelines for quorum, voting and proxies as law supersedes the parliamentary authority. Leadership of the organization needs to be cognizant of these rules and when they differ.
